Terms of Service

1. Acceptance of Terms

By accessing or using the Recovery Journey platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms. If you do not agree to these Terms, do not use the Service.

2. Description of Service

Recovery Journey provides a HIPAA-compliant substance abuse recovery management platform, including a clinician desktop application, patient mobile application, secure messaging, and related tools for treatment facilities and addiction counselors.

3. Account Registration

You must register for an account to use the Service. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Acceptable Use

You agree not to:

• Use the Service in violation of any applicable laws or regulations
• Access or attempt to access accounts, systems, or data not intended for you
• Interfere with or disrupt the integrity or performance of the Service
• Attempt to reverse engineer, decompile, or disassemble any part of the Service
• Use the Service to store or transmit malicious code or content
• Share account credentials with unauthorized individuals

5. HIPAA Compliance

For customers who are covered entities or business associates under HIPAA, use of the Service is subject to the terms of an executed Business Associate Agreement (BAA). You are responsible for ensuring that your use of the Service complies with all applicable healthcare regulations, including HIPAA and 42 CFR Part 2 where applicable.

6. Fees and Payment

Fees for the Service are based on the plan selected during registration. Fees are billed monthly or annually as chosen. All fees are non-refundable except as expressly set forth in these Terms. We reserve the right to change pricing with 30 days advance notice. Continued use of the Service after a pricing change constitutes acceptance of the new pricing.

7. Data Ownership

You retain all rights to your data. We do not claim ownership of any content or data you submit to the Service. We use your data only to provide the Service and as described in our Privacy Policy. Upon termination, you may export your data for 90 days before it is securely deleted.

8. Service Availability

We strive to maintain 99.9% uptime for the Service. However, we do not guarantee uninterrupted or error-free operation. Scheduled maintenance will be communicated in advance. We are not liable for downtime caused by factors beyond our reasonable control.

9. Intellectual Property

The Service, including all software, designs, text, and documentation, is owned by Recovery Journey and protected by intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose during your subscription period.

10. Limitation of Liability

To the maximum extent permitted by law, Recovery Journey shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising out of or relating to the Service. Our total liability for any claims arising under these Terms shall not exceed the fees paid by you in the twelve months preceding the claim.

11. Termination

Either party may terminate these Terms at any time with 30 days written notice. We may suspend or terminate your account immediately for violation of these Terms. Upon termination, your right to use the Service ceases immediately. Data export rights survive for 90 days after termination.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws provisions. Any disputes arising from these Terms shall be resolved in the courts located in Delaware.

13. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or through the Service at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
